Welcome to Ottimo.AI. By accessing or using our platform at ottimo.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. The Service

Ottimo.AI is an AI-powered travel planning platform that generates personalized itineraries based on your preferences. The Service uses artificial intelligence to suggest destinations, accommodations, activities, flights, and other travel-related content. These suggestions are provided for informational and inspirational purposes. All travel decisions, bookings, and arrangements are ultimately your own responsibility.

2. Eligibility and Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it up to date.

3. Third-Party Booking Links

The Service contains links to third-party travel providers such as Booking.com, Viator, airlines, and other booking platforms ("Third-Party Providers"). When you click a booking link and leave ottimo.ai, you are interacting directly with that Third-Party Provider. We strive to link only to reputable, well-established providers. However, Ottimo.AI does not control, endorse, or guarantee the products, services, pricing, availability, or practices of any Third-Party Provider. Any transaction you enter into with a Third-Party Provider is solely between you and that provider. It is your responsibility to review the terms of service, privacy policy, cancellation policy, and any other conditions of each Third-Party Provider before making a booking. Ottimo.AI accepts no liability for any loss, damage, dispute, or dissatisfaction arising from your use of Third-Party Provider services.

4. User-Generated Content and Trip Licensing

When you create a trip on Ottimo.AI and choose to make it publicly visible, you grant Ottimo.AI a worldwide, royalty-free, non-exclusive, sublicensable licence to display, distribute, reproduce, and promote that trip content on the platform and in related marketing materials. This licence exists for the purpose of operating and improving the Service. You retain ownership of your content. You may delete your trips at any time via your dashboard, and upon deletion the licence for that specific content will terminate, though copies already shared or cached by other users or search engines may persist. You represent that any content you submit does not infringe on the rights of any third party.

5. Points and Rewards

Ottimo.AI may offer a points programme in which users earn points when bookings are made through their shared trips. Points have no cash value and cannot be transferred, sold, or exchanged for money. Ottimo.AI reserves the right to modify, suspend, or discontinue the points programme, adjust point values, or expire unused points, at any time and without prior notice. Abuse of the points system (including self-referrals or fraudulent activity) may result in forfeiture of points and termination of your account.

6. Acceptable Use

You agree not to use the Service to: upload harmful, offensive, or unlawful content; attempt to reverse-engineer, scrape, or interfere with the platform's operation; impersonate another person or entity; or use automated tools to access the Service without prior written permission. We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

The Ottimo.AI platform, including its design, logo, software, AI models, and all original content, is the property of Ottimo.AI and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED ITINERARIES WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS. TRAVEL INVOLVES INHERENT RISKS. YOU ACKNOWLEDGE THAT AI-GENERATED RECOMMENDATIONS MAY CONTAIN ERRORS, OUTDATED INFORMATION, OR SUGGESTIONS THAT ARE NOT APPROPRIATE FOR YOUR PERSONAL CIRCUMSTANCES, AND YOU AGREE TO VERIFY ALL CRITICAL INFORMATION INDEPENDENTLY BEFORE MAKING TRAVEL ARRANGEMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OTTIMO.AI, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.

10. Modifications

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, notify registered users via email or an in-platform notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
